Number of convictions

The number of judicial convictions in 2008 (38 226) fell by 11.4% (-4 932 cases) in comparison with reporting year 2007. This meant that the number of convictions fell to a historical all-time low. Overall, the number of convictions (based on 1 000 persons legally considered as of the age of criminal responsibility) for 2008 was 5.33, the lowest figures since these statistics were first compiled in 1947. Only in the year 2001 this figure was also lower than six-tenth of a percent.

The number of convicted adults (35 238) fell by 12.1% (-4 836 cases) compared to 2007. However, the number of convicted young persons (2 988 cases) was down by just 96 cases (-0.03%) in comparison to the previous year.

The number of criminal convictions (33 044) for crimes in contravention of the Austrian Criminal Code showed a fall of 9.4% (-3 438 cases) from 2008 compared with 2007. Broken down by type of offence, there was a decline in nearly all subgroups. Convictions for offences against life and limb dropped by -5.3%, those against liberty by 15.0%. Relatively strong was also the decline of convictions against property (-9.6%).

The number of convictions in contravention of supplementary penal provisions outside the Austrian Criminal Code (5 182 cases in total) decreased in comparison to the previous year by -22.4% which is more than one fifth; convictions for offences in contravention of the Narcotic Substances Act fell by 21.1% (-1.146 cases).
